Obtaining Child Custody and Change in Custody

When a parent seeks custody of a child during initial divorce or paternity proceedings, they need to demonstrate that it is in the child’s best interest to be with them. They don’t need to show that the other parent is unfit. Some ways to show that a child should be with you include:

  • Desire to have the child live with you
  • Demonstrating your involvement in your child’s life (in school activities, medical appointments, sports, and shared activities)
  • Positive relationships and interactions between parent and child
  • Supportive home, school, and community environment
  • Willingness to encourage a continuing relationship with the other parent

If you are seeking to change an existing child custody agreement, your task can be much harder. Now you must prove that the other parent is unfit or that there has been a substantial change of circumstances that is affecting the child’s health or welfare. The court wants children to have stability, and generally won’t consider a change of custody within the first two years or a family court order or agreement except in cases of significant abuse.
